Privacy Policies and Practices

Protecting your privacy is important to Pinnacle and our employees. You provide important information about yourself when you do business with our financial institution. In order to provide our customers with a broad range of financial services, we use technology to manage and maintain customer information. We will tell you the sources of the information we collect about you. We will tell you the measures we take to secure that information. Our privacy policies and practices apply to both current and former customers. For purposes of this notice, the term “customer(s)” refers to individual(s) who obtain or have obtained from us a financial product or services used primarily for personal, family or household purposes.     

Definition of terms

Nonpublic personal information means information about you that we obtain in connection with providing a financial product or service to you. Nonpublic information does not include information that is available from public sources, such as telephone directories or government records.  An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control. A nonaffiliated third party is a person we do not employ or a company that is not an affiliate of ours.

Information We Collect

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on applications and other forms;
  • Information about your transactions with us, our affiliates, or others; and
  • Information we receive from a consumer reporting agency.

Information We May Disclose

We do not disclose nonpublic information about you to nonaffiliated third parties unless:

  • You request or authorize the disclosure;
  • The information is provided to help complete a transaction initiated by you;
  • The information is provided to a reputable credit bureau or similar consumer reporting agency; or
  • The disclosure is otherwise authorized or permitted by law.

Information we disclose to companies that perform marketing services on our behalf or to other financial institutions with which we have joint marketing agreements is limited to your name, address and account type(s) with us. We do not disclose any other nonpublic personal information about our customers or former customers to anyone, except as permitted by law.

Maintaining Accurate Information

Maintaining the accuracy of your personal information is important. We have procedures to provide a high level of assurance that your personal information is accurate, current and complete. We also have procedures to correct inaccurate information in a timely manner. If you discover information you believe is inaccurate, please do not hesitate to contact us.

Employee Access to Information is Limited

We have policies and procedures in place to limit access to your personal information to those employees with a specific business need to know such information. Our employees are educated and trained on the importance of confidentiality and privacy of customer information. Any employee who fails to adhere to our privacy policies and procedures is subject to discipline, including termination.

Protection of Information Through Established Security Procedures  

We establish and maintain procedures designed to protect privacy and confidentiality of our customers’ information. These include physical security practices to minimize the risk of unauthorized access to documents containing confidential information. We also have internal controls to prevent unauthorized access to information on our computers, and we have an independent review of our computer operations on an annual basis, to evaluate those controls.

Maintaining Your Privacy When We Do Business Outside Our Bank

It is sometimes necessary to provide personally identifiable information about you to a third party outside CapitalMark, such as when we hire a vendor or service company to provide support for one of our products or services. When we work with outside businesses, we require these vendors or service providers to sign confidentiality agreements with CapitalMark that prohibit them from using customer information for any purpose other than that for which they have been contracted. These outside vendors are required to abide by applicable privacy law and regulations.
